Man slips off platform, hit by NJ Transit train

RED BANK, NJ — New Jersey Transit says a man suffered a broken leg when he slipped off a train station platform and was struck by a train.

The accident occurred around 6:15 a.m. Sunday in Red Bank.

NJ Transit spokesman John D'Urso Jr. says the man apparently slipped and fell on to the tracks. He was soon hit by North Jersey Coast Line train No. 7208.

No passengers or crew members aboard the northbound train were injured in the accident. The passengers were soon transferred to another train to complete their journey.

The injured man's name was not released. He was being treated at a hospital, but further details on his injuries were not disclosed.

Michelle Obama, friends and family remember inaugural performer shot dead

CHICAGO — Hundreds of mourners and dignitaries including first lady Michelle Obama stood and applauded the family of a 15-year-old Chicago girl for their strength Saturday, a week and a half after her death brought national attention to the city's staggering gun violence.

A funeral service was held Saturday for Hadiya Pendleton, a band majorette who was shot and killed on Jan. 29, just a few days after performing for events surrounding President Barack Obama's inauguration. Police say Pendleton was an innocent victim in a gang-related shooting.

Michelle Obama met privately with the family and accompanied the girl's mother to the open casket at the front of a packed South Side church just before the start of the service.

Obama, who grew up on Chicago's South Side, put her arm around Cleopatra Pendleton and patted her back. The woman threw her head back and wailed as the lid of her daughter's flower-strewn casket was closed.

Moments later, the hundreds in attendance rose to their feet to begin the service with a round of applause "to the strength of this family." Then, the choir began to sing so loud the floor shook.

Some of Illinois' most recognizable politicians and clergy were also in attendance, including Chicago Mayor Rahm Emanuel, U.S. Rep. Bobby Rush, the Rev. Jesse Jackson and Father Michael Pfleger. But Pendleton's family says her Saturday funeral service was not about politics — it was about remembering a girl who loved to dance, who once appeared in an anti-gang video.

"Everything is about Hadiya," said Shatira Wilks, one of Pendleton's cousins and a family spokeswoman.

None of the dignitaries was slated to speak during the service, which was officiated by the teen's pastor, the Rev. Courtney Maxwell, and the Rev. Eric Thomas, the pastor of the Greater Harvest Baptist Church, where the service was held. The teen's brother was also expected to speak, and the musical group that Pendleton was a member of will perform.

Pendleton was shot and killed while she talked with friends after school at a park not far from the Obamas' home in the Kenwood neighborhood. Police have said the shooting appears to be a case of mistaken identity involving gang members who believed the park was their territory. No charges have been filed.

Pendleton's death brought new attention to Chicago's homicide rate and the national debate over gun violence. Pendleton's slaying came in a January that was the city's deadliest in a decade. In 2012, Chicago recorded 506 homicides.

Earlier Saturday morning, a line of hundreds stretched from the church as mourners filed past Pendleton's casket. A woman who walked in with the girl's family sobbed loudly while organ and piano music played.

A glossy, eight-page funeral program included photos of Pendleton and details about her life, including her favorite foods — cheeseburgers, fig cookies, Chinese and ice cream — and the numerous school organizations she was involved in, and said she wanted to major in pharmacology and journalism in college.

The program also included a copy of a handwritten note from President Obama addressed to the girl's family.

"Michelle and I just wanted you to know how heartbroken we are to have heard about Hadiya's passing," it reads. "We know that no words from us can soothe the pain, but rest assured that we are praying for you, and that we will continue to work as hard as we can to end this senseless violence. God bless, Barack Obama."

Other dignitaries at the service were Gov. Pat Quinn, U.S. Education Secretary Arne Duncan and White House senior adviser Valerie Jarrett — all of whom are from Chicago.

Quinn mentioned Pendleton's death in his State of the State address earlier this week as he called for a ban on assault weapons and high-capacity ammunition magazines.

"There are no words in the English language . or any language . to relieve the pain of parents who lose a child," said Quinn, who said he spoke with Pendleton's family two days before his speech.

'Nemo' storms Twitter

As a massive blizzard is set to hit New York, the jokesters on Twitter have already taken the golden opportunity to mix the title character from Disney/Pixar's "Finding Nemo" with weather-related humor.

The storm, nickednamed "Nemo" by the Weather Channel, is no laughing matter -- winds could reach 75 mph and over two feet of snow could accumulate in some places.

BLIZZARD NEMO COULD BRING HEAVY WINDS AND A FOOT OF SNOW TO NYC

Such conditions could bring down power lines with authorities fearing widespread power outages, but apparently the Twitterverse is unafraid of such disaster scenarios, including its own @nemoflakes Twitter account.

Some of the better lines the account has spawned include: "The only reason I'm dumping 3 feet of snow on New England is because .... Tom Brady. #nemo" and "I went from a movie star to making the front page headline. #fishproblems."

Below we've pulled together some of the best blizzard Nemo memes making their way through Twitter right now.

787 battery approval should be reconsidered: NTSB

AP

This slide shown on a video screen during a news conference at the National Transportation Safety Board (NTSB) today shows a comparison of an exemplar battery with the Japan Airlines Boeing 787 battery.

WASHINGTON — The government should reassess its safety approval of the Boeing 787 lithium ion batteries, the nation's top accident investigator said Thursday.

National Transportation Safety Board Chairman Deborah Hersman said the board's investigation of last month's battery fire in a Japan Airlines 787 "Dreamliner" while it was parked in Boston shows the fire started with multiple short-circuits in one of the battery's eight cells. That created an uncontrolled chemical reaction known as "thermal runaway" and spread to the rest of the cells, she said.

That's at odds with what Boeing told the Federal Aviation Administration when the agency was working to certify the innovative aircraft for flight, Hersman said. The manufacturer asserted its testing showed that any short circuiting could be contained within a single cell, preventing thermal runaway and fire, she said.

Boeing's testing also showed the batteries were likely to cause smoke in only 1 in 10 million flight hours, she said. But the Boston fire was followed nine days later by a smoking battery in an All Nippon Airways plane that made an emergency landing in Japan.

The 787, Boeing's newest and most technologically advanced plane, has recorded less than 100,000 flight hours, Hersman noted.

The same day as the ANA emergency landing, FAA officials ordered the only U.S. carrier with 787s — United Airlines, which has six of the planes — to ground them. Aviation authorities in other countries swiftly followed suit. In all, 50 planes operated by seven airlines in six countries are grounded.

The groundings have become a nightmare for the company, which has about 800 Dreamliner orders from airlines around the world.

The 787 is the first airliner to make extensive use of lithium batteries. Aircraft makers view the batteries, which are lighter and can store more energy than other types of batteries of an equivalent size, as an important way to save on fuel costs. The Airbus A350, expected to be ready next year, will also make extensive use of lithium ion batteries. Manufacturers are also looking to retrofit existing planes, replacing other types of batteries with lithium ion.

But lithium batteries are more likely to short circuit and start a fire than other batteries if they are damaged, if there is a manufacturing flaw or if they are exposed to excessive heat.

MTA unveils interactive subway map

Now you can get up close and personal with New York subways.

The MTA rolled out an online interactive map today that’ll allow users to zoom in, or fade back, on an image of the system.

Before, users could only pull up a fixed PDF image. That option is still available.

“The subway map is one of the most popular tools we provide on our Web site, and we want to make it as easy and convenient as possible for visitors to the city and New Yorkers alike to get the most out of the map online,” said MTA spokesman Paul Fleuranges.

Texas couple rent fancy Manhattan condo to 'revolving door of complete strangers': lawsuit

A Texas couple turned a designer Manhattan condo into a virtual flophouse by renting their unit to transient, hard partying guests, a new lawsuit alleges.

Robert and Marilyn Blodgett, of Houston, have allegedly used 3K "as a vacation rental property,” drawing a “revolving door of complete strangers,” despite repeated cease and desist demands from the condo board of 340 E. 23rd Street, the Manhattan Supreme Court suit states.

The couple owns a vacation website called Luxe VR, which markets high-end properties across the U.S. to travelers for stays of a few days to many weeks.

At least 27 tourists have bedded down in 3K since August 2011, but it was recent guest Malcolm Kee, who sent residents into a tizzy, according to court documents.

Kee, in his mid-twenties, checked in on Jan. 14, allegedly threw three ragging parties, invited friends who threatened and cursed out building staff, and still hasn't checked out, the lawsuit claims.

Attempts to curb Kee's alleged bad behavior have proven unsuccessful. “Much to the horror of the residents of neighboring unit 3L, Kee, his travel companion, or one of his party guests responded in a retaliatory manner by defacing 3L’s doorway with an obscene depiction of male genitalia,” court papers claim.

“It’s amazing to me that you could be in this luxury condo building and pay millions of dollars for your apartment and right next door you have some crazy person,” said the condo board’s attorney, Steven Sladkus.

For $299 a night tourists “can experience living like a real Manhattanite,” a website for the rental boasts, adding that the address is a short walk to “famous restaurants and bars and Third and First Avenue.”

The board of the Gramercy Condominium, by celebrity designer Phillippe Starck, wants to shut down the illegal hotel and unspecified monetary damages.

Sladkus said the practice of renting out units on a short-term basis has proliferated in the past year.

“Unfortunately there’s a big trend lately for people renting out their condo units on a short-term basis,” said Sladkus. The practice “not only violates most building’s bylaws, but also violates the Multiple Dwelling Law that says essentially you can’t have paying guests for less than 30 days.”

Sladkus said the unit’s owners, the Blodgetts, have completely ignored three requests to stop the rentals. The Blodgetts did not immediately return phone and email messages seeking comment.

Deadly deserts

Violence in Allah’s name in northern Africa won’t end in my lifetime — and probably not in yours. The core question is: To what extent can the savagery be contained?

From the Atlantic coastline to the Suez Canal, struggling governments, impoverished populations and frankly backward societies struggle to find paths to modernization and to compete in a ruthless global economy. Religious fanatics for whom progress is a betrayal of faith hope to block development.

Still, if the only conflict was between Islamist terrorists and those who want civilized lives, the situation could be managed over time. But that struggle forms only one level in a layer cake of clashing visions and outright civil wars bedeviling a vast region. Much larger than Europe, the zone of contention encompasses the Maghreb, the countries touching the Mediterranean, and the Sahel, the bitterly poor states stretching down across desert wastes to the African savannah.

AFP/Getty Images

Figthers of the Islamic group Ansar Dine

The Sahel is the front line not only between the world of Islam and Christian-animist cultures in Africa’s heart, but between Arabs and light-skinned tribes in the north, and blacks to the south. No area in the world so explicitly illustrates the late, great Samuel Huntington’s concept of “the clash of civilizations.”

If racial and religious differences were not challenge enough, in the Maghreb the factions and interest groups are still more complicated. We view Egypt as locked in a contest between Islamists and “our guys,” Egyptians seeking new freedoms. But Egypt’s identity struggle is far more complex, involving social liberals, moderate Muslims, stern conservative Muslims (such as the Muslim Brotherhood) and outright fanatics. The military forms another constituency, while the business community defends its selfish interests. Then there are the supporters of the old Mubarak regime, the masses of educated-but-unemployed youth and the bitterly poor peasants.

Atop all that there’s the question of whether the values cherished by Arab societies can adapt to a globalized world.

The path to Egypt’s future will not be smooth — yet Egypt’s chances are better than those of many of its neighbors. Consider a few key countries in the region:

Mali

Viva la France! (Never thought I’d write that in The Post.) Contrary to a lot of media nonsense, the effective French intervention in Mali demonstrates that not every military response to Islamist terror has to become another Afghanistan: The French are welcome.

As extremists invariably do, al Qaeda in the Islamic Maghreb (AQIM) and its allies rapidly alienated their fellow Muslims — after hijacking a local uprising. The local version of Islam is far more humane and tolerant than the Wahhabi cult imposed by Islamist fanatics. To the foreign extremists, the Malian love of Sufi mysticism, ancient shrines and their own centuries of religious scholarship are all hateful — as is the Malian genius for music that’s pleased listeners around the world.

Energy Secretary Chu steps down after Solyndra scandal

WASHINGTON — Energy Secretary Steven Chu, who won a Nobel Prize in physics but came under questioning for his handling of a solar energy loan, is stepping down.

Chu offered his resignation to President Barack Obama in a letter Friday. He said he will stay on at least until the end of February and may stay until a successor is confirmed.

Chu's departure had been widely expected and follows announcements by Interior Secretary Ken Salazar, Environmental Protection Agency chief Lisa Jackson and Jane Lubchenco, head of the National Oceanic and Atmospheric Administration, that they are leaving.

The White House said no decisions have been made on replacements for any of the environment and energy jobs but said Obama's priorities will remain unchanged. Potential replacements for Chu include former North Dakota Sen. Byron Dorgan, former Michigan Gov. Jennifer Granholm and former Washington Gov. Chris Gregoire.

Obama said in a statement Friday that Chu brought a "unique understanding of both the urgent challenge presented by climate change and the tremendous opportunity that clean energy represents for our economy."

During his tenure, Chu helped move the country toward energy independence, Obama said, citing Energy Department programs to boost renewable energy such as wind and solar power.

"Thanks to Steve, we also expanded support for our brightest engineers and entrepreneurs as they pursue groundbreaking innovations that could transform our energy future," Obama said.

Chu, a former director of the Lawrence Berkeley National Lab, had little political experience before taking the energy post in 2009.

He drew fire from congressional Republicans who criticized his handling of a $528 million federal loan to solar panel maker Solyndra, which later went bankrupt, laying off its 1,100 workers. Republicans said Chu and other Energy Department officials missed many warning signs about problems at Solyndra and compounded them by approving a restructuring of the loan even after problems were discovered.

Solyndra was the first renewable-energy company to receive a loan guarantee under the 2009 stimulus law, and the Obama administration frequently promoted the company as a model for its clean energy program. Chu attended a 2009 groundbreaking when the loan was announced, and Obama visited the company's Fremont, Calif., headquarters the next year.

The company's implosion in 2011 and revelations that the administration hurried a review of the loan in time for the groundbreaking become an embarrassment for Chu and Obama and a rallying cry for GOP critics of the administration's green energy program.

Lawmakers also criticized Chu for approving the plan to restructure Solyndra's debt so that two private investors moved ahead of taxpayers for repayment in case of default.

Chu defended the Solyndra loan during a sometimes testy hearing in late 2011. While calling the ultimate outcome "regrettable," Chu said the loan was subject to "proper, rigorous scrutiny and healthy debate" before it was approved in 2009.

"While we are disappointed in the outcome of this particular loan, we support Congress' mandate to finance the deployment of innovative technologies and believe that our portfolio of loans does so responsibly," Chu said.

The White House said Chu retained Obama's confidence, but Chu was widely expected to leave following Obama's re-election last fall.

In a letter to Energy Department employees, Chu said he was proud of his tenure and cited dozens of accomplishments, including doubling the production of renewable energy from wind and solar power. Installations of small solar electric, or photovoltaic, systems have nearly doubled in each of the last three years, he said, while fully 42 percent of new energy capacity in the U.S. last year was from wind —more than any other energy source, Chu said.

"I came with dreams and am leaving with a set of accomplishments that we should all be proud of," he said.

One of his accomplishments was something that Chu rarely talked about: Obama repeatedly credits Chu with helping to plug the massive BP oil spill in the Gulf of Mexico. Chu and a team of engineers helped devised an interim solution before a replacement well permanently plugged the leak, which spewed more than 200 million gallons of oil in the worst offshore oil disaster in the country's history.

57-year-old allegedly 'brutally murdered' his young baby mama while she slept: DA

"I will kill her," the white-haired ex-lover had vowed.

And when the corpse of young and pretty Sherra Morgenstern was finally found in her Second Avenue bed -- maggot-ridden, still in pajamas, and with two shell casings in her hair -- it was the ex-lover's handiwork, prosecutors told a Manhattan jury today, describing a callous, 2009 murder.

Edward Demirojian, 57, a former limousine owner from Orlando, Fla., is on trial for allegedly killing Morgenstern -- a woman half his age and the mother of his young child, Shakira -- in order to keep the child and collect on a $250,000 insurance policy.

Steven Hirsch

Edward Demirojian

"The defendant brutally murdered her inside her home, while she was asleep and helpless," Assistant District Attorney Shanda Strain told jurors in opening statements this morning.

The smell was horrid, the victim's mother, who discovered the body, told jurors this afternoon.

"It smelled like, uh, I would say like a dead smell," a tearful Sheila Morgenstern, 72, testified.

"Like rigor mortis," she said. "I saw my daughter laying there dead. And I screamed."

The couple's child, Shakira, was just three years old, and living with Demirojian in Orlando when cell tower records show he drove up to New York in July of 2009, the prosecutor told jurors in openings.

Morgenstern, who lived in Jefferson Houses in East Houses, had just announced her intent to move decisively to regain custody, the prosecutor said the evidence will show.

But Demirojian -- who is listening to testimony via an Arabic translator -- would stop at no ends to keep the child, the prosecutor said. In the trial's first testimony, the victim's best friend recounted a phone conversation with Demirojian from a year before the murder.

"He said, 'Before she ever gets the baby back, she'll be dead,' " the friend, Marva Puerto, said Demirojian told her. "'I'll kill her.' And behind that remark, he was, 'Ha, ha,' like it was a funny remark. A funny matter."

The .357-cal shell casings in Morgenstern's hair match Demirojian's registered handgun, and cell tower records show his phone moved up the Eastern Seaboard and arrived in Manhattan on the day of the murder, the prosecutor said.

Demirojian is further implicated by alibi lies he told family and cops, and by the $250,000 policy he'd been trying repeatedly to collect on, the prosecutor said.

But the defense contends that there are no forensics directly linking Demirojian to the murder.

"The evidence will show that no other forensic evidence was recovered from Sherra Morgenstern's apartment -- no DNA, no fingerprints, no hair or fiber," said defense lawyer Robert Weinstein.

The lawyer suggested that "many others" had access to Morgenstern's apartment. And the policy? It had been taken out by Morgenstern herself, he told jurors.

Testimony is expected to continue through next week.

Time Inc. to cut 500 jobs or 6 percent of staff

Time Inc. CEO Laura Lang said she is in the process of slashing 500 jobs, or about 6 percent of its global staff of 8,000, as the publisher wrestles with slumping print advertising.

The layoffs are part of Time Warner CEO Jeff Bewkes’ mandate to shave $100 million in costs from the hard-pressed publishing subsidiary. The problem for Time Inc. and other publishers is that digital revenue—while growing rapidly—isn’t enough to offset the erosion of print ad dollars.

The company, which is home to venerable weeklies such as Time, People and Sports Illustrated, has had bigger cutbacks in terms of absolute numbers, but this latest round is the largest on a percentage basis. The Post first reported earlier this month that Time Inc. would shed between 500 and 700 jobs.

Getty Images

Time Inc. CEO Laura Lang

“With the significant and ongoing changes in our industry, we must continue to transform out company into one that is leaner, more nimble and more innately multi-platform,” said Lang, who joined Time over a year ago from digital ad firm Digitas, where she was the CEO.

“To make this change, we need to operate as smartly and efficiently as possible to create room for critical investments and new initiatives. These reductions are part of this important transformation process.”

Insiders said that less than half the cuts will be at Time Inc.’s New York headquarters.

The cutbacks will also hit London-based subsidiary IPC and the back-shop operation in Tampa, Fla., where a sizable staff that falls under the consumer marketing division is responsible for handling subscription-renewal efforts.

The consumer marketing unit has been without an operating head for close to a year.

Some in the rank-and-file gripe that the cutbacks are taking place in the absence of any clear direction forward for the company.

“This is just cutting for the sake of cutting,” said one high ranking insider.

“We need to do it, I guess,” said another insider. “But people want to know what is going on. We need a global road show — and it should start inside.”

Herbalife preps online counterattack against Ackman

Bill Ackman has gotten under Herbalife’s skin.

The nutritional supplements company that Ackman dissed as a “pyramid scheme” has purchased three domain names related to the hedge fund tycoon.

Herbalife has owned “therealbillackman.com,” “billackman.net” and “therealackman.net” since Jan. 18, according to Go Daddy’s database of registered domain names. So far, the sites are inactive.

The domain names appear to be part of a bigger Internet and social media campaign kicked off after Ackman’s paid search engine ad “factsaboutherbalife.com” topped Google’s search rankings about the company.

REUTERS

Bill Ackman

That Web site details Ackman’s case against the company. The hedge fund honcho announced Dec. 19 that he made a $1 billion short bet against the company because he thinks it’s a pyramid scheme that will be shut down by regulators. Herbalife has called his claims “bogus.”

Not wanting the top search result to be what analyst Tim Ramey calls a “slam Web site,” Herbalife likely paid up to have its own search engine ad top Ackman’s.

“I’m sure they’re getting lots of creative advice on how to control the message,” said Ramey of DA Davidson. Herbalife has also been posting paid announcements on Twitter.

Herbalife’s shares are down 54 cents, or 1.35 percent, at $39.48.

Neither Herbalife nor Ackman could be reached for comment.

Time Warner taps home entertainment boss as company chairman

Time Warner tapped home entertainment boss Kevin Tsujihara to lead all of Warner Bros. Entertainment, ending a years-long search.

Tsujihara is taking over from Barry Meyer as the chairman of the film and TV business, starting March 1.

The news came as a surprise to Tinseltown insiders who considered Bruce Rosenblum, who oversees Warner’s TV studio, the frontrunner.

“Obviously, I’m disappointed; who wouldn’t be?” Rosenblum said in a statement. “Warner Bros. is a unique and special place and I know it will be in good hands with Kevin at the helm.”

Tsujihara was competing not only with Rosenblum but also film boss Jeff Robinov, the president of Warner Bros. Pictures. It is unclear whether the runner-up execs will be taking on new roles.

Startraks Photo

Kevin Tsujihara

Time Warner head honcho Jeff Bewkes set up a three-way bake-off for the top job after persuading current boss Meyer to stay on through 2013.

While Tsujihara was the dark horse candidate, it seems his knowledge of the digital media realm put him over the top.

He has led Warner Bros. Home Entertainment Group as president since 2005. He oversees digital distribution, video games and emerging technology initiatives.

“It is an honor to have the opportunity to lead this storied business,” Tsujihara said in a statement.

“We’re at a pivotal moment in the histories of Hollywood and entertainment: technology is changing the canvas we use to create theatrical releases; home entertainment is rapidly evolving; and the definition of television now includes viewing across a wide range of devices and services.”

Two arrested for stealing Hurricane Sandy relief supplies from Staten Island church

“It’s like stealing from God.”

A pair of heartless fiends were arrested yesterday after they were caught stealing donated supplies for Hurricane Sandy victims from a church.

Edwin Rios, 46, of Arden Heights, and William Banks, 43, of St. George, were nabbed at the Christian Pentecostal Church early Friday trying to put 35 cases of bottled water into a rented truck.

“When you see creeps like this, it bothers me. If you need it, come get it, but when you take stuff like this it’s like stealing from God,” Pastor Dr. John Rocco Carlo told the Staten Island Advance.

Carlo, a retired NYPD detective, said the thefts began before Thanksgiving, and he reached out to police. The church has been a lifeline for Sandy victims still in need of help.

“I’m glad they caught two of the guys. But to me it looks like a gang, you don’t just operate like this with a couple of people,” Carlo surmised.

The thieves had been hoisting themselves over walls to get into the locked parking lot where the supplies were stored and making off with blankets, diapers, cleaning supplies and other items.

The NYPD set up a sting operation, leaving the parking lot gate open.

Rios and Banks were charged with criminal possession of a controlled substance, petty larceny and criminal trespass.

Court sets aside 2 of 4 Casey Anthony convictions

ORLANDO, Fla. — A Florida appellate court on Friday set aside two of the four convictions Casey Anthony faced for lying to detectives during the investigation into her missing 2-year-old daughter.

Judges on the 5th District Court of Appeals agreed with Anthony's attorneys that two of the charges constituted double jeopardy, or being convicted or punished more than once for the same crime.

"We cannot conclude that the Legislature intended to authorize separate punishment for each false statement made during a single interview," the judges said in their ruling.

AP

Casey Anthony

Anthony was acquitted of killing Caylee in 2011. Jurors convicted her of four counts of lying to detectives, and her attorneys appealed those convictions. Anthony was sentenced to time served for the misdemeanors.

She was sentenced to a year of probation after her release from jail for an unrelated case. Her whereabouts have been kept secret since she was released from state supervision last year.

Jurors determined that Anthony lied when she told detectives that she worked at Universal Studios, that she had left Caylee with a babysitter who kidnapped the girl, that she had told two friends about her daughter's disappearance and that she had received a phone call from Caylee.

The appeals judges ruled that the trial court was correct to allow Anthony's statements to detectives to be used during her murder trial. Anthony's attorneys had argued that she was in police custody at the time and hadn't been read her Miranda rights. They also had argued that Anthony should have been convicted of only a single count of lying because of the double jeopardy concern.

But the judges said there was a break in time between two interviews Anthony had with detectives.

"Where there is a sufficient temporal break between two alleged criminal acts so as to have allowed a defendant time to pause, reflect and form a new criminal intent, a separate criminal episode will have occurred," the judges said.

A clue? Clintons house hunting in Hamptons - choose broker who listed 'White House'

Bill and Hillary Clinton are house hunting in the Hamptons.

The former president, 66, and wanna-be future president, 65, are looking for an oceanfront property where they can unwind and prepare for their next phase of life, sources tell the Post.

On the heels of her recent health scare, Hillary Clinton — who had a blood clot in her head — is about to step down as Secretary of State and is potentially plotting a 2016 presidential run.

The Clintons have been summering in the Hamptons and enjoy its unique mix of R&R and highly social scene, sources tell The Post.

While they have in the past rented a $19 million home on Lily Pond Lane, the political duo have decided to “mix it up” and look elsewhere a source said, adding that they are working with Saunders & Associates.

One of the homes Saunders lists is dubbed the 'White House,' but that $6.9 million home is not private or stately enough for the power pair.

The Clintons own a home in Washington, DC, and a Chappaqua home they purchased prior to Hillary's successful run for Senate.

Knicks top Lakers as most valuable NBA team

The New York Knicks have pulled back ahead of the Los Angeles Lakers to top Forbes’ annual ranking of the most valuable NBA teams.

The Knicks rose 41 percent in value to $1.1 billion, thanks largely to the ongoing renovation of Madison Square Garden, which led to more suite sales, ads and sponsorships, Forbes Senior Editor Kurt Badenhausen told The Post.

The overhaul resulted in the Knicks leading the league in revenue with $243 million.

The Lakers fell to No. 2 and are valued at $1 billion, up a more modest 11 percent. Last year, the Lakers were ahead of the Knicks because of a lucrative cable rights deals the team signed with Time Warner Cable.

Besides the new arena, the Knicks sold the most NBA merchandise, showing that fan support is growing, Badenhausen said.

Teams on average this year gained 30 percent in value due to the league’s new collective bargaining agreement.

The Brooklyn Nets — boosted by the move from New Jersey — are valued at $530 million, up 48 percent.

Badenhausen said the Nets may not make money this year, when considering the $30 million-plus annual pilot payments its owners pay for the new stadium.

But revenue will rise significantly from $84 million last year to what sources project could reach $140 million.

The woman whose photo was used as the "face" of the Twitter account of Manti Te'o's supposed girlfriend says the man allegedly behind the hoax confessed and apologized to her.

Diane O'Meara spoke to NBC's "Today" show Tuesday. She says Ronaiah Tuiasosopo used pictures of her without her knowledge in creating a fake woman called Lennay Kekua. Te'o asserts he was tricked into an online romance with Kekua and, until last week, believed she died of leukemia in September.

O'Meara went to high school with Tuiasosopo, but she says they're not close. She says he called to apologize Jan. 16, the day Deadspin.com broke the hoax story, but "I don't think there's anything he could say to me that would fix this."

The 23-year-old O'Meara is a marketing executive in Los Angeles. She says that for five years, Tuiasosopo "has literally been stalking my Facebook and stealing my photos."
