Miami-Dade Police: One dead, one wounded in Friday night shooting

Miami-Dade homicide detectives are investigating a Friday night shooting that killed one man and sent another to a hospital.

The shooting started about 8:11 p.m. in the area of 17th Avenue and Northwest 92nd Street in West Little River, according to police. People began arguing and then fighting, and then “several shots were fired,” according to a police statement.

One victim, a 22-year-old man, was killed at the scene of the shooting. A second, 40-year-old man was taken to Jackson Memorial Hospital’s Ryder Trauma Center, where police said he is listed in critical condition. Neither man has been identified.

Police are searching for the shooter.

Larry Hagman Dies

Larry Hagman, best known for playing Dallas villain J.R. Ewing, died Friday morning from complications stemming from his recent battle with cancer.

He was 81 years old.

"Larry was back in his beloved Dallas, re-enacting the iconic role he loved most," the family said in a statement via The Dallas Morning News. "When he passed, he was surrounded by loved ones. It was a peaceful passing, just as he had wished for. The family requests privacy at this time."

Hagman's Dallas co-stars Linda Gray (who played his wife Sue Ellen) and Patrick Duffy (who played his brother Bobby) were reportedly at his bedside when he died, The Sun is reporting.

"Larry Hagman was my best friend for 35 years. He was the Pied Piper of life and brought joy to everyone he knew," Gray tells ET in a statement. "He was creative, generous, funny, loving and talented, and I will miss him enormously. He was an original and lived life to the fullest ... The world was a brighter place because of Larry Hagman."

Hagman, who also starred as Air Force Captain Anthony Nelson in I Dream of Jeannie, was last seen on television in TNT's Dallas reboot, where he returned to play his most well-known character.

"Larry Hagman was a giant, a larger-than-life personality whose iconic performance as J.R. Ewing will endure as one of the most indelible in entertainment history," Warner Bros., Dallas executive producers Cynthia Cidre and Michael M. Robin, and the show's cast and crew said in a statement. "He truly loved portraying this globally recognized character, and he leaves a legacy of entertainment, generosity and grace. Everyone at Warner Bros. and in the Dallas family is deeply saddened by Larry's passing, and our thoughts are with his family and dear friends during this difficult time."

"It was truly an honor to share the screen with Mr. Larry Hagman," Dallas reboot star Jesse Metcalfe, who plays Christopher Ewing, said in a statement. "With piercing wit and undeniable charm he brought to life one of the most legendary television characters of all time. But to know the man, however briefly, was to know a passion and dedication for life and acting that was profoundly inspirational."

Queens man murdered after gun-toting teen followed him off train

A Queens man was murdered after a gun-toting teen followed him off a train, police sources said today.

Peren Phillippe, 21, of Rockaway Park boarded the A train yesterday evening with a pal at the Far Rockaway-Mott Avenue stop and got off at the Beach 44th Street stop shortly before 8:15 p.m., sources said.

Diamonte Alexander, 18, of Far Rockaway followed Phillippe off the train and allegedly gunned down the victim on Rockaway Beach Boulevard near the subway stop, shooting him in the torso and legs, cops said.

EMS rushed Phillippe to Jamaica Hospital, where he died.

Police pursued Alexander after they received a description of the suspect, sources said.

During a chase, Alexander allegedly tried to ditch a 9mm pistol.

Cops quickly apprehended him, and he was charged with murder and criminal possession of a weapon.

The victim's friend said the two did not know the suspect, and the motive behind the slaying was not immediately clear.

Sources said Phillippe had a rap sheet of six prior arrests, including two busts for weapon possession. The rest were sealed, sources added.

For Miami, new cruise ships a cause for celebration

Miami’s ship has come in. And it looks more like a fleet.

The Carnival Breeze, which starts regular sailings from its new year-round home Saturday, will be joined Thursday by Oceania Cruises’ Riviera and Dec. 1 by Celebrity Reflection. All three launched earlier this year in Europe and make their U.S. debut in Miami.

After a three-year dry stretch that saw no shiny new vessels mooring in Miami’s waters — and years of efforts to draw new operators coupled with millions spent on upgrades — the port is touting its biggest expansion ever with the three new ships as well as three new cruise lines signing on for this season and next.

“You want your newest ships to have the newest facilities, and that’s what Miami has done,” said Miami cruise expert Stewart Chiron, CEO of CruiseGuy.com.

Regent Seven Seas Cruises moved its ships from Port Everglades in Fort Lauderdale to Miami, and Disney Cruise Line will sail for the first time from Miami starting in late December. Next year, MSC will bring its newest ship, Divina, to Miami after previously sailing from Fort Lauderdale.

And Miami-based Norwegian Cruise Line, which reignited the parade of new ships in 2010 with the Norwegian Epic, is bringing the 4,000-passenger Norwegian Getaway in January 2014 to Miami, where it will sail year-round.

“I never, ever would have considered going anywhere else, because we are a Miami company and we really believe that means something,” said Kevin Sheehan, Norwegian’s president and CEO.

That hasn’t always been the universal sentiment. Nearly six years ago, the port was under fire for a history of inefficiency and sub-par facilities. In late 2007, Royal Caribbean chose Port Everglades in Fort Lauderdale as homeport for Oasis and Allure of the Seas, the world’s largest cruise ships — despite having a Miami headquarters.

The presence of those giant ships has meant some other cruise lines felt the squeeze, and a couple, like Regent Seven Seas Cruises and MSC Cruises, have opted to move south.

“Once upon a time, Port Everglades was known as the boutique cruise ship port,” said Frank Del Rio, chairman and CEO of Prestige Cruise Holdings, parent company of Oceania and the luxury Regent Seven Seas. “Now Port Everglades is the megaship port. We’re the antithesis of megaships.”

But Chiron said the moves aren’t necessarily a negative for Fort Lauderdale’s port.

“These ship movements and repositionings, all it’s really doing is opening up both ports for really bright future opportunities,” he said.

Port Everglades has grown its multiday cruise passenger numbers from about 2.6 million in fiscal 2008 to an expected more than 3.6 million on 45 ships in fiscal year 2012. By comparison, PortMiami’s passenger numbers have grown from about 3.8 million in 2008 to what is expected to be more than 4 million with 26 ships at the peak for the current fiscal year.

For its part, Port Everglades continues to invest in upgrades, recently finishing the $54 million reconstruction of four cruise terminals under a 2010 agreement with Carnival Corp. for brands including Holland America Line, Seabourn and Princess Cruises.

The investments go on at PortMiami as well, where director Bill Johnson, who took the job in 2006, listened to criticism that Miami hadn’t done enough to support the cruise industry. In the last few years, the port built a pair of terminals for Carnival for about $100 million. Since those terminals opened about four years ago, the port will have spent and continues to spend $70 million more in improvements, Johnson said.

Small plane makes emergency landing in Southwest Ranches

A small, ultralight airplane made an emergency landing onto an open cow pasture in Southwest Ranches on Friday. No one was injured, Broward Sheriff’s Office reported, and the airplane did not suffer any significant damage.

Two people were aboard the plane, said Dani Moschella, a BSO spokeswoman. An investigation into the cause of the emergency landing will be conducted by the Federal Aviation Administration.

The plane went down in the area of Griffin and Hancock roads.

Michelle Obama, daughters welcome White House Christmas tree

WASHINGTON — First lady Michelle Obama is kicking off the holiday season by welcoming the White House Christmas tree.

Mrs. Obama, daughters Malia and Sasha and first dog Bo greeted the arrival of a 19-foot Fraser fir from Peak Farms in Jefferson, N.C.

The tree arrived Friday on a horse-drawn carriage. It will be displayed in the Blue Room of the White House.

The first lady says the tree is "perfect."

The fir tree comes from the farm of 2012 National Christmas Tree Association grand champion winners Rusty and Beau Estes.

Members of the association have presented the official White House Christmas tree every year since 1966.

Allure of Brickell, downtown Miami drives up rental rates

When Brett Smith rented a condo at Axis Brickell last year, there were still sweet deals to be found, but when the lease came up for renewal last month, he got a sour note: The rent was spiking 15 percent.

The three-bedroom, three-bath condo would cost $3,800 a month, up from $3,300.

“We actually looked around at other places, and most looked to be around the same price range,” said Smith, a 25-year-old construction project manager who shares the apartment with two friends. “We decided with the cost of moving, we would just stay.”

Smith, who loves the urban lifestyle — “It’s great, and it’s getting better,” he says — has lots of company.

In greater downtown Miami and Brickell, residential rental rates per square foot jumped 10 percent in the first nine months of 2012 from a year earlier, according to a study conducted for Miami Downtown Development Authority by Coral Gables-based Focus Real Estate Advisors.

Rents for the sizzling Brickell neighborhood leaped even more sharply. The average monthly rental rate for Brickell jumped 17 percent to $2,242 in the first nine months of 2012 from the same period in 2010, while the rent per square foot spiked 28 percent over that period, according to additional data from Focus Real Estate Advisors and MLxchange.

Fueling the price increases: Strong demand for rental units and the growing popularity of the downtown and Brickell areas as new restaurants and entertainment spots help mold an urban core that is attractive to young professionals and students but also to an increasingly diverse crowd.

“It’s become like a restaurant Mecca in Brickell,” said Denise Sicuso, sales manager for Esslinger-Wooten-Maxwell Realty’s Brickell downtown office, which handles lots of condo rentals and sales in the area.

With Brickell CitiCentre, a massive $1.05-billion mixed-use complex with retail, entertainment, office and residential, going up at 701 South Miami Avenue, “the interest in the neighborhood is only increasing,” Sicuso added. “When we get rental listings, they’re gone within a week.”

More than 95 percent of rental units in the greater downtown Miami area are occupied, according to the Downtown Development Authority study.

Demand for rental units is strong for many reasons: Tough lending standards for mortgages are making it difficult for many people to buy a home. Coming out of the recession and housing meltdown, many people have credit histories that exclude them from becoming buyers. Others simply don’t want to own.

At the same time, a steady influx of foreigners and others relocating to Miami is bolstering rental demand, as is the gradually improving economy that is enabling some young people who had moved back to the nest with their parents to get their own place.

“There is pent-up demand for rentals, not unique to the downtown or Brickell area,” said Craig Werley, president of Focus Real Estate.

Another factor: Many of the professionally managed rental apartment buildings in South Florida were converted into condominiums before the real-estate market crashed.

Professionally managed apartment buildings account for just 10 percent of Miami’s rental market, down from 20 percent in 2000, according to Werley.

While there is a major push by developers and institutional investors to build more multifamily rental units in South Florida (and around the country), the lag time before new rental units would come to market means supply will be tight for some time.

Amazon Kindle Fire HD 8.9 is Good, But No iPad Killer [REVIEW]

Amazon expands its tablet sights with the bigger, more powerful Kindle Fire HD 8.9. Can it compete against Apple‘s iPad?

If there’s one company that deserves credit for reigniting the iPad competitor market, it’s Amazon. Despite some bugs and an overall blah design, its 7-inch Kindle Fire was the first Android tablet that made sense to consumers who gobbled it up to help the Fire grab 50% of the Android tablet market in just 6 months.

That tablet essentially opened the flood gates for a new set of ever-more-powerful 7-inchers from, notably, Barnes & Noble and Google. All three companies have already updated their 7-inch offerings to more powerful components and higher-resolutions screens. They’re all still running Android, though Amazon and Barnes & Noble choose to hide the Google OS behind smarter and much more consumer-friendly interfaces.

All this led Apple to finally enter the mid-sized tablet space with the iPad Mini. It’s easily the best-looking tablet of the bunch, but also $ 120 more expensive than its nearest competitor.

The more interesting development, though, is Amazon‘s (and Barnes & Noble‘s) decision to go toe-to-toe with Apple’s full-size iPad and launch the Amazon Kindle Fire HD 8.9 (in 4G LTE and WiFi-only). The move is akin to a middle weight boxer putting on the pounds to take on the Heavyweight world champion. Amazon’s Kindle Fire HD is slightly smaller (the iPad is 9.7-inches), lighter (567g vs. 625g), cheaper ($ 369 for 32 GB model vs. $ 599 for the iPad 4th Gen — Amazon subsidizes with sleep-state ads, that I do not mind) and overall somewhat less powerful. In order to win the battle, the 8.9-inch Kindle Fire HD better be pretty nimble on its feet, while able to throw that all important knockout punch.

Short version of this story: the Kindle Fire HD 8.9 does some serious damage, but the iPad 4th Gen gets the decision and retains the tablet leader title.

The Kindle Fire HD 8.9 is by no means a failure. In many ways, it’s as good as the smaller Kindle Fire HD, but throughout my tests I noticed odd bugs and glitches (which should all be fixable by software) and a somewhat disturbing lack of power that’s especially obvious when you put the Fire HD 8.9 next to the iPad 4th Gen

What It Is

If you’ve never seen an iPad and someone handed you the Kindle Fire HD .9, you’d likely say its jet-black, soft-to-the-touch plastic body felt good in your hands and was more than effective at all the core tasks (reading, game playing, e-mail, web browsing).

Design-wise, the 8.9 device looks exactly like the 7-inch model, complete with the too-hard to find volume and power buttons. There are no other physical buttons on this device, but Amazon chooses to hide the few it has by making them the exact same color as the chassis and flush with the body. Every time I use the tablet I do the “where’s the damn button” dance, rotating the Kindle Fire HD round and round until I feel the buttons (since I can barely see them).

I have applauded Barnes & Noble for putting the physical “N” home button right on the face of their Nook HD. Bravo for having the guts to do this. Amazon apparently looks at Apple’s iPad home button and thinks to have anything similar would be seen as “copying” the Cupertino hardware giant, when instead they should realize that it works, consumers like it and tablets without it are at a distinct disadvantage.

Amazon’s interface has you make do with a virtual, slide-out home button that is always available. Problem is, I found times when it wasn’t available. When I played Spider-Man and Asphalt 7, the tiny little left-had bar would disappear and I couldn’t exit the game unless I hit the sleep/power button.

The rest of the Kindle Fire HD 8.9′s body is solid and unremarkable (if you read my Kindle fire HD 7 review, then you know exactly what to expect.). Like the iPad 4th Gen, the Kindle Fire HD 8.9 has a front-facing 720p-capable camera. It’s useful for capturing video, snapping 1 Megapixel images and, probably most important, Skype video chats. Skype has built a fairly sharp-looing Kindle Fire app, though the design doesn’t fully fit the larger 8.9-inch screen. Skype just updated its Android app for better tablet viewing and hopefully, we’ll see this update hit the Kindle Fire HD 8.9 as well.

The iPad also has an HD rear-facing camera. The Kindle fire HD 8.9 does not (Barnes & Noble leave out cameras altogether)

Not Packing a Punch

As a large-screen high-resolution tablet (though iPad’s 2048×1536 retina display beats it), the Kindle Fire HD 8.9 offers plenty of attractive screen real estate for web browsing, book and magazine reading and games. But the results can be mixed. Silk, Amazon‘s custom web browser, was occasionally less than responsive and games, though, they ran well, never looked half as good as they do on the considerably more expensive iPad 4.

Granted, you can’t always find the same high-quality immersive action games on both Android and iOS, but Asphalt 7 Heat is a notable exception and it throws the performance differences between the two tablets into stark contrast. Game play is equally responsive on both platforms: the Kindle Fire HD 8.9’s accelerometer reads my moves just as well as the iPad.

The graphics on the Kindle Fire HD, however, are reduced to blobs and blocks (palm trees without distinct leaves, buildings without discernible windows) . The iPad’s quad-core graphics simply overmatch the Kindle Fire. I have never, for example, seen an iPad draw the game as I was playing, as I did when I tried out The Amazing Spider-Man.

Additionally, I experienced more than my share of crashes with games and even magazine apps like Vanity Fair.

The Good

Not everyone, however, will compare the Kindle Fire HD 8.9 to the iPad. Some will see the $ 299 entry-level price point (for the 16 GB model) and appreciate the power, flexibility and utility of this device. Like all Fire’s before it, the Kindle Fire HD 8.9 makes it easy to consume mass quantities of content. Nearly every menu option: Games, Apps, Books, Music, Videos, Newsstand, puts you just one click away from shopping for fresh content. If you have an Amazon account (and who doesn’t) your desired book, music or movie is just a click away. Plus, you can still easily store any of it locally, and worry about running out of storage space, or in the cloud, and never worry about space or accessibility—you can get to that purchased Kindle content from any Kindle app or registered Amazon device.

Watching movies on the tablet is a pleasure. I streamed a couple through Amazon Prime; they looked good on the 1920 x 1200 screen and the Dolby Stereo speakers produced sharp, loud, almost room-filling sound—an impressive feat not even the iPad can match.

The Kindle Fire HD 8.9 also includes a mini-HDMI-out port, which prompted me to connect the tablet to my 47-inch LED HDTV so we could watch Disney’s Brave. Yes, I had to get up and tap on the Kindle screen each time I wanted to pause and restart the move, but otherwise, I was pretty impressed with how the Kindle handled the task.

Obviously I yearn for an Apple Airplay-like feature on Android tablets (rumor has it one is coming), but this is the next, best thing.

There isn’t a lot to say about the Kindle Fire HD 8.9-inch interface that I did not say in the Kindle Fire HD 7 review. I will note, however, that the increased real estate makes the trademark task carousel seem almost too big. Icons for everything from your recently played Spider-Man game to magazine apps, books and Web sites all sit side-by-side-by side. Some, like book covers, look gorgeous.

Others like a broken web-page link look stupid. Worse yet, none of them have labels, which can occasionally make it hard to identify which app or task you’re looking at. I’m just not sure this interface metaphor is sustainable.

Personally I prefer either the clean consistent look of iOS, or the uber-user friendly, family-oriented Nook HD profile-based one. Amazon may want to take a hard look at those and start over.

Staying Connected

The Kindle Fire HD 8.9 is also Amazon’s first cellular-based tablet. That fact puts it even more squarely in competition with the iPad (which obviously has always had 3G models and now offers blazing fast 4G LTE ones as well on all major carriers).

Amazon’s mobile broadband plans are a little more conservative, with just the AT&T 4G LTE option (the 32 GB 4G model that I tested lists for $ 499, which is still $ 224 less than a comparable iPad 4th Gen).

In my experience, the connectivity is superfast and fairly ubiquitous. Amazon‘s $ 49 (a year) flat fee plan is attractive, but with a cap of 250MB per month of data, it’s unlikely it will satisfy the most data-hungry users. If you do need more data, users can also get 3GB and 5GB data plans directly from AT&T on the device.

At press time, Amazon had not enabled streaming video over LTE. Having it sounds nice, but even with the most generous data plans, streaming video would eat it up faster than you can say, “I’m streaming Back to the Future in HD over 4G LTE on my Kindle fire HD!”

The reality for most users is that WiFi is plentiful and you’ll be hard pressed to find a spot where you can’t connect for free or a small one-off fee. It’s the reason Barnes & Noble’s line of HD Nooks do not include a cellular option.

Perhaps the best new addition to the Kindle Fire family is not a piece of hardware or new component, but the new FreeTime app. Amazon put a lot of loving care into this parental control interface, but almost mucks the whole thing up by hiding the tool under an app that you have to scroll down to (or search) to find. By contrast profiles and age and content controls are baked into the Barnes & Noble Nook HD in a way that makes them impossible to ignore.

Even so, once you do access FreeTime, I think you’ll be pleased with the level of control it gives you. I added test profiles for my two children and then hand-picked every app and piece of content they could access. I was also able to block broadband mobile and even set time limits for access to content and overall screen viewing time (on a per profile basis). The set-up is a bit wonky and it bizarrely switches between landscape and profile screens, but I still applaud the effort. It would make sense for Amazon to move FreeTime into a device set-up screen. If the user has no additional family members or kids using the device, they can easily skip it.

To Buy or Not to Buy

Amazon’s expansive content and shopping ecosystem has always been a strong draw and it’s just as good in this large screen tablet as it was in the very first Kindle Fire. Still, you have to compare it with the equally strong iOS ecosystem, which is no slouch in the content shopping department. Apple doesn’t connect you as seamlessly to physical products, but there’s nothing difficult about shopping on Amazon.com via your iPad. It’s also notable that tablet competitor Barnes & Noble has added movie and TV viewing, rental and purchase.

Ultimately, all of these tablets are offering more and more of the same content options, apps, and features. The decision will likely come down to price, app selection, interface and overall ease of use. The Amazon Kindle fire HD 8.9 scores well on all of these, but does not always lead.

For the price, it’s a great value, but I want Amazon to focus on hardware and interface design for the next big update. Then, they may get my full endorsement.

Seaside Heights roller coaster submerged by Sandy may be left there

A man walks on the beach as a rollercoaster that once sat on the Funtown Pier in Seaside Heights, NJ rests in the ocean.

SEASIDE HEIGHTS, NJ — The remains of a roller coaster that was knocked off a New Jersey amusement pier by Superstorm Sandy and partially submerged in the Atlantic Ocean may be left there as a tourist attraction.

Seaside Heights Mayor Bill Akers tells WNBC-TV in New York that officials have not made a decision on whether to tear down the coaster. But the mayor says he's working with the Coast Guard to see if the coaster is stable enough to leave it alone, because he believes it would make "a great tourist attraction."

Meanwhile, efforts to rebuild the storm-ravaged town are continuing.

Demolition crews have removed the resort's damaged boardwalk. And Akers says construction on a new boardwalk should begin in January and be ready by Memorial Day.

Marling Sequeira has her Thanksgiving all planned: turkey, trimmings and pumpkin pie at her boyfriend’s in Miami, then a moonlit drive to Walmart to snag a 72-inch Samsung TV on sale for $800.

“It’s more exciting at midnight,” said Sequeira, 22, a medical assistant who is moving into a new Brickell-area apartment with her boyfriend on Friday. “Besides that, the specials are more convenient.”

All over South Florida on Thursday, bargain-hungry shoppers will be gobbling down their Thanksgiving meals with an eye on heading to the mall.

Thursday is becoming the new Black Thursday, as the old-fashioned kickoff day of the holiday, Black Friday, creeps into Thanksgiving dessert.

“Retailers are now commercializing Thanksgiving, giving the opportunity to the consumer who doesn’t want to watch 12 hours of football,” said Marshal Cohen, chief retail analyst at the NPD Group, a consumer and retail market research firm based in Port Washington, N.Y.

The stores’ goal, he said, is to compete more vigorously with online sites for those valuable early holiday dollars.

And retailers have learned that if they open their doors and offer deals, shoppers will come. Last year those who extended their hours saw sales rise up to 22 percent for the Black Friday weekend, while those retailers that did not lost up to 8 percent, Cohen said.

The result: this year, more than ever, shopping is seeping into Thanksgiving festivities.

Kmart is opening at 6 a.m. and Bass Pro Shops at 8 a.m. on Thursday. Sears and Toys”R”Us are opening at 8 p.m. Target is opening at 9 p.m. Loads of stores, including Macy’s, The Gap, Old Navy and Best Buy are opening at midnight. Best Buy is promising deals on such items as TVs, laptop computers, digital cameras and more.

Walmart is open 24 hours, so it will stay open all day on Thanksgiving, with specials offered at 8 p.m. and 10 p.m. on Thursday and 5 a.m. on Friday.

“Whether you want to stay up late on Thursday night or get up early on Friday, at Walmart we have a Black Friday event for you,” said spokesman Steve Restivo. Walmart is offering price guarantees to shoppers who are inside a store between 10 p.m. and 11 p.m., on three hot-selling items, an Apple iPad2, an Emerson 32-inch LCD TV and an LG Blu-ray player.

In South Florida, even entire malls will open on Thanksgiving. Dolphin Mall in Sweetwater and Sawgrass Mills in Sunrise will be first, each opening at 9 p.m., and staying open until 10 p.m. and 9:30 p.m., respectively, on Black Friday.

Dadeland Mall and Miami International Mall will open at midnight Thursday.

“We’re very excited to open at midnight and give our shoppers a head start to the holiday season,” said Sara Valega, director of marketing for Miami International Mall, which will stay open until 11 p.m. on Friday.

Nationwide, 17 percent of consumers, or 41 million people are expected to shop on Thanksgiving, according to the latest consumer holiday tracking survey, released Tuesday by The International Council of Shopping Centers and Goldman Sachs.

With stores opening earlier and earlier, and some retailers launching pre-Thanksgiving sales, the retail industry has officially crossed the traditional Black Friday barrier — with no end in sight, said Kimberly Taylor, associate professor of marketing at Florida International University.

High court ruling on deportation issue does not apply to past cases, Florida Supreme Court says

A Miami man who could face deportation for an 11-year-old drug charge is not eligible to have his conviction thrown out, the Florida Supreme Court ruled Wednesday.

Gabriel Hernandez, now a successful bank administrator, had asked a Miami trial court to toss out his 2001 drug conviction, saying his lawyer failed to properly warn him he could face deportation to his native Nicaragua.

Like hundreds of defendants statewide, Hernandez filed his request after the U.S. Supreme Court in March 2010 threw out the conviction for a Kentucky man, Jose Padilla, whose lawyer failed to warn him that he would be deported after pleading guilty.

But a Miami judge refused Hernandez’s request. And The Third District Court of Appeal ruled that the Padilla case did not apply to past cases like Hernandez’s.

On Wednesday, the Florida Supreme Court agreed unanimously that the Padilla case is not “retroactive.”

The issue of “retroactivity” has been closely watched in legal circles as thousands of people across the country — who could face deportation because of past convictions — sought help under the Padilla case.

Wednesday’s decision in Florida is not the final say for Hernandez.

Ultimately, the U.S. Supreme Court will decide whether its own decision in Padilla applies retroactively.

Last month, the nation’s high court heard arguments for a Chicago woman, Roselva Chaidez, who is facing deportation for 9-year-old conviction for fraud. No ruling has been issued.

Hernandez arrived in the United States from Nicaragua when he was 2 years old. Now 30 and a legal resident, he boasts a bachelor’s degree and works as a successful computer network administrator for a Miami bank group.

His one blemish was at 19, when he was arrested on charges of selling LSD.

In an outcome typical for first-time offenders, Hernandez pleaded guilty and accepted a year of probation in return for a promise that no felony conviction would appear on his record. But Hernandez insists he never understood that the plea deal could wind up getting him deported to Nicaragua.

Facebook proposes to end voting on privacy issues

NEW YORK (AP) — Facebook is proposing to end its practice of letting users vote on changes to its privacy policies. The company says it will continue to let users comment on proposed updates.

The world’s biggest social media company plans to announce Wednesday that its voting mechanism, which is triggered only if enough people comment on proposed changes, has become a system that emphasizes the quantity of responses over the quality of discussion.

Facebook began letting users vote on privacy changes in 2009. Since then, it has gone public and its user base has ballooned from around 200 million to more than 1 billion. As part of the 2009 policy, users’ votes only count if more than 30 percent of all Facebook’s active users partake.

The 'Sister Wives' Fight Over House Size

According to this exclusive clip from an all-new episode of TLC hit Sister Wives, among the many complications that arise from Kody Brown having four wives is the sister wives' arguments over their respective house sizes.

Although each of Kody's wives has their own house which is supposed to be comprised of the same budget, the other wives can't understand why first wife Meri needs as big a house as the others when she has less children.

Tufts rescinds Lance Armstrong's honorary degree

MEDFORD, Mass. — Tufts University in Massachusetts has rescinded Lance Armstrong's honorary degree.

A university spokeswoman says the school's trustees voted unanimously at their meeting this month to rescind the doctor of humane letters bestowed upon Armstrong in 2006.

During his keynote speech in which he revealed a Tufts cycling jersey beneath his academic robes, Armstrong talked about his battle with testicular cancer and the need for everyone to get involved. He told graduates: "Be active. Be involved. Be heard. Be aggressive. Be smart. Don't be afraid."

The university said Wednesday that while respecting Armstrong's cancer-fighting efforts, the board concluded his "actions as an athlete are inconsistent with the values of the university."

Don’t want to brave the Black Friday craziness? You can get a head start on your holiday shopping, snag some deals and support local merchants by participating in Small Business Saturday.

Nestled between Black Friday and Cyber Monday, Small Business Saturday is focused on promoting small business owners nationwide. Since it was started in 2010 by American Express, the promotional effort has grown into a national movement involving thousands of businesses, chambers of commerce and economic development organizations. According to American Express, last year more than 100 million people nationwide participated.

“The one thing businesses have told us over and over again is that they need more customers. So we thought it would be great to create a day in the holiday weekend that focuses just on the small business and shopping locally in communities around the country,” said Mary Ann Fitzmaurice Reilly, senior vice president at American Express Open.. “That’s how Small Business Saturday got its start.”

American Express cardholders who sign up at shopsmall.com will get a $25 credit on their bill if they make a purchase from a participating business on Small Business Saturday. Participating businesses get free marketing support from American Express via a toolkit on its website.

On Saturday, the Coral Gables Chamber, along with American Express, the Village of Merrick Park and Books & Books will host a day of activities, including a $100 Startup Competition, inspired by the best-selling book by Chris Guillebeau. Entrepreneurs are encouraged to bring their most innovative ideas for a business that can be launched with just $100 (register at http://100dollarstartup.co). Finalists will pitch their startup ideas to the public at the 4 p.m. event, held at Books & Books in Coral Gables; a panel of judges will select the winners.

Kendall man confesses to suffocating, raping wife and 8-year-old daughter, police say

A Kendall man confessed to suffocating his wife and raping her 8-year-old daughter inside a West Miami-Dade home, police say.

Alberto Sierra, 28, was charged early Tuesday with the murder of Gladys Machado and her two young daughters, whose bodies were found inside the bedroom closet of a home last week. Machado was also raped, according to an arrest report.

The shocking details cap a furious police investigation into a brutal killing that shocked South Florida. He is charged with three counts of first-degree murder and two counts of sexual battery.

Sierra, a convicted felon who was long the main focus of the investigation, confessed after hours of questioning Monday night. Also on Monday, detectives found Machado’s missing car near the Kendall apartment where Sierra was staying with his mother.

According to an arrest report, Sierra accompanied Machado and her daughters to the Mall of the Americas in West Miami-Dade. The on-again-off-again couple began to argue and Sierra, armed with a knife, stabbed her.

Then, he drove the three to the Flagami-area home where the family had lived up until recently. The home was vacant because the couple had split.

According to police, Sierra put the daughters in an adjacent bedroom and suffocated Machado in the master bedroom, then raping her. Then, Miami-Dade police said, Sierra called the oldest daughter to the master bedroom, raping and suffocating her.

Then, police say, Sierra went to the other bedroom and suffocated the youngest daughter as she slept.

The bodies were not found until Tuesday afternoon. A woman who rents an efficiency in the home found Machado and Julia and Daniela Padrino, ages 8 and 4, laid out inside a closet.

A convicted felon with a long rap sheet, Sierra walked into the Kendall substation last Wednesday. After homicide detectives questioned him for several hours, he was allowed to leave. His criminal history includes convictions for drugs and weapons.

But armed with forensic evidence, Miami-Dade homicide detectives called him in for questioning Monday and he confessed.

Sierra has a violent past. Back in 2010, Machado told police he bit her arm during a heated argument. Investigators later found him with 79 grams of Ecstasy, a stolen 9mm Smith & Wesson pistol and ammo.

After he was sentenced to one year of probation, he and Machado were married in October 2011.

That same month, Sierra was also investigated by the state’s child welfare agency after Julia told a teacher that her stepdad had bitten her on the arm.

The girls’ biological father asked for sole custody of the children, but the Department of Children and Families closed out its investigation when Sierra was again arrested in November on charges of possessing a firearm by a convicted felon. At the time, he was living with Machado at the same Flagami-area house where she was later found dead.

Officers seized a rifle, a shotgun and ammo. His probation was also revoked and Sierra later pleaded guilty and was sentenced to 364 days in a Miami-Dade jail.

In June, Sierra was released from a Miami-Dade jail and had returned to living with Machado. It is not known when the two separated.

Mystery man ruled out in Brooklyn serial killer investigation

Police have ruled out a person of interest seen in this sketch from the Aug. 2 murder in Bensonhurst.

Cops have ruled out a person of interest in one of the murders committed by the Brooklyn serial killer, saying that the subject of a police sketch released in August has no connection to the slayings.

NYPD Commissioner Ray Kelly said the man in the sketch circulated after the Aug. 2 Bensonhurst murder of Isaac Kadare, 59, was in the area at the time.

"That was a sketch that surfaced with one of the previous murders, it is no longer relevant," said Kelly. "That individual washed out again. That individual was somebody we wanted to talk to, who may have been in the area. He’s not a subject, he’s a person we simply wanted to speak to."

"It was someone that we wanted to speak to in the area. I believe that individual was interviewed."

Cops are still hunting for a mysterious man toting a duffel bag identified as a key “person of interest” after surveillance video showed him at one -- and possibly two -- of the three slay scenes, law-enforcement sources told The Post yesterday.

"We would obviously like that individual to come forward and contact us," Kelly said today.

The unidentified man -- dubbed “John Doe Duffel Bag” -- who is middle-aged, white and balding, was most recently caught on surveillance video, duffel bag in hand, at around 6 p.m. Friday near the Flatbush store where owner Rahmatollah Vahidipour, 78, was found dead at 7:11 p.m., cops said.

Another video appears to show the same man near a Bensonhurst shop around the time its owner Kadare was killed, several sources said yesterday.

Kelly today disputed the claim that he was spotted at older murders.

“That’s not the case,” he said.

The duffel man has no known connection to the first murder of shopkeeper Mohammed Gebeli, 65, in his Bay Ridge clothing store on July 6.

All three murders were committed with the same .22-caliber handgun, and all three occurred while the lone business owner was closing up shop.

All three bodies were also covered when they were discovered, cops said.

"It may be significant, it may not, but in all three cases, the victim’s head was covered either by cardboard or clothing of some sort," said Kelly.

Startups take the stage at South Florida events

NewME brought its first Popup Accelerator to Miami last week, and together with the Knight Foundation and LAB Miami, gave 65 South Florida participants a two-night pitch workshop, a one-on-one mentoring session with a Silicon Valley venture capitalist or NewME expert and the opportunity to present their ventures at Demo Night.

On Wednesday evening, 38 startup teams pitched to a crowd filling the risers of The Light Box Theater in Wynwood, and competed for tens of thousands of dollars in prizes. On the intimate stage, the teams made their two-minute pitches, each one accompanied by a pitch deck of 8 to 10 slides.

“Can’t you feel the energy? This is super exciting,” said Matt Haggman, program director of the Knight Foundation’s Miami office, which has been supporting and funding projects to help the startup community. “What’s going on here clearly shows there is something special happening and we look forward to contributing to it further.”

After the pitches, which were judged by two investors and Angela Benton, founder of NewME, Benton announced the winners:

•  First place: Sew Love, pitched by Sabrina Scandar. Sewlove.co, founded by sisters Sabrina and Silvia Scandar, is a platform for crowdsourcing fashion design. The Scandars want to raise $300,000 to help them continue developing their platform, make some key hires and fire up a marketing strategy. They won a prize package worth $45,000 in goods and services to help them build their startup, plus they were accepted into NewME’s 2013 Accelerator class.

•  Second place: Gozump, pitched by Charleston Malkemus. Gozump is a platform to help people buy homes, which will begin by targeting the military market. “We are Marines on a mission to change the way real estate works forever,” Malkemus pitched. Gozump won $23,000 in goods and services.

•  Third place, Indira, pitched by Carrie Ann Mantha: Indira is a fashion tech platform that creates personalized fashion and decor for weddings. It has a factory running in Little Haiti and is launching next month. Indira won $7,000 in goods and services.

Honorable mentions: ToddlerTV, SkillU, GoGeekster and NightPro. “We thought the judging process would be a lot easier. There was a lot of great technology,” said Benton, speaking Friday by phone after returning to San Francisco, where the NewME Accelerator is based.

All winners received co-working space at LAB Miami, which is soon moving to a larger space in the Wynwood neighborhood. All participants received a one-month “connect” membership to LAB Miami. Read more about the NewME PopUp here.

Many of the PopUp participants said getting the opportunity to mingle with other startups in South Florida was also valuable.

“We were really excited to meet more of the startup tech community,” said Mantha, who moved Indira from New York City to Little Haiti about six months ago. “It is much more dynamic than we realized.”

Last week was also big for other entrepreneurs taking the stage. Several hundred women attended the two-day Women’s Success Summit, where summit founder Michelle Villalobos and her business partner Jessica Kizorek laid out a system for work/life balance (hint: It starts with scheduling in your playtime, involves firing your least-profitable clients and includes developing strong systems for efficiency.)

Legislature doesn’t need to approve increase in doctors’ pay, says spokeswoman

A spokeswoman for incoming Senate President Don Gaetz said Monday that the Legislature does not have to take any action in order for Florida’s primary care doctors to start receiving increased Medicaid payments starting Jan. 1 -- the first time that providers will received direct financial benefits from Obamacare.

That position directly contradicts statements last week from the office of Gov. Rick Scott and from the Agency for Healthcare Administration, which said the Legislature or the Legislative Budget Commission needed to approve the increased payments.

Katie Betta, deputy chief of staff for the senate, told The Herald, “The increased payment is mandatory and the kind of change that can happen automatically. The funding is already included in the base as part of the outlook and the estimating conference. This is not unlike other examples of mandatory changes that were implemented automatically.”

Last week, staffers of the U.S. Department of Health and Human Services in Washington told journalists the same thing: The payments could increase automatically.

On Friday, Scott spokeswoman Jackie Schutz said: “AHCA would need additional budget authority to receive the federal funds to pay the increased rates. The LBC has to grant that authority. We are waiting to hear if the LBC will meet in December.”

Earlier, AHCA spokeswoman Shelisha Coleman said, “The Florida Legislature must provide authority for the Medicaid program to draw down federal funds to cover the fee increase.”

The increased rates are mandated by the Affordable Care Act. Doctors’ groups have long complained that Medicaid rates in Florida are so low that many doctors refuse to treat patients covered by the state-federal insurance for the poor.

The Obama administration wants to increase payments to provide better primary care so that patients don’t wind up in emergency rooms, where care is far more expensive, and to increase the number of doctors willing to take Medicaid as the program expands in 2014.

Scott sent a letter to Washington last week, seeking to open negotiations with the Obama administration to find ways to lower healthcare costs — something Scott says the reform act does not do.

Gaetz has said he favors increased primary care payments but is concerned that Obamacare will end federal support for programs, leaving states with increased costs in the future.

In fact, increased Medicaid payments to doctors sunset in two years.

In Mark Cuban’s Humble Opinion, Facebook Still Kinda Sucks

Dallas Mavericks owner and billionaire Mark Cuban has confirmed reports from last week, in a post on his personal blog today, that he has a serious beef with Facebook. But before getting into all the reasons he no longer loves the social network, he clarifies one small point: “First, I’m not recommending to any of my companies that we leave facebook,” he writes. Last week ReadWriteWeb’s Dan Lyons kind of made it seem like Cuban planned to pull out altogether because of the way Facebook’s algorithm has affected the way people see his brands’s posts. The algorithm, Edgerank, controls brand posts so that not all fans are forced to see each one in their news feeds. Because of this, he quoted Cuban saying “We are moving far more aggressively into Twitter and reducing any and all emphasis on Facebook.” And later he had him talking about all the reasons he finds it horrible for businesses. Like, mainly, that it’s too expensive, a point that GigaOm’s Mathew Ingram called naive. “Really? That surprises you? What else did you think Facebook was going to do when it gave you a giant social platform for nothing?” Cuban now explains that he isn’t bailing on Facebook, just de-emphasizing it in favor of other Internet places, like Tumblr and Twitter. But, that does not mean that he does not hate Facebook as much as everyone has been saying he hates Facebook. He does.

Basically Mark Cuban thinks Facebook should stop trying to make money and stop trying to get too smart, which might work in the favor of Cuban who doesn’t want to spend too much money on something silly like social media. But,this doesn’t sound too appealing to Facebook, which as a public company needs to make money. Unless more join his cause, which could maybe happen. At least the Miami blog the 305 agrees with him. During a guest-hosting gig on Anderson Live, Rosie O'Donnell opens up about life after her heart attack and says she is successfully losing weight in her transition to a healthier lifestyle.

While Anderson Cooper is on location reporting on the latest developments in the Middle East, Rosie teamed up with Real Housewives of Atlanta star NeNe Leakes to hold down the fort on his daytime talk show.

When co-host NeNe tells Rosie she's looking good, she responds by addressing her health scare. "Thanks, you know I had a heart attack. I keep telling everyone I had a heart attack and my kids are like, 'Will you shut up already?' And I am like, 'No, I had a heart attack.'"

Elmo accuser backtracks after recanting, wants to void $125G deal: report

The man who accused Elmo voice Kevin Clash of having underaged sex with him, reportedly wants to recant his recantation.

Sheldon Stephens, 24, is interviewing lawyers in hopes of ripping up the $125,000 deal he reached last week with the famed puppeteer Clash, according to TMZ.

Stephens’s Pennsylvania lawyers last week released this statement: 'He [Stephens] wants it to be known that his sexual relationship with Mr. Clash was an adult consensual relationship.”

Now Stephens wants to go back to his previous position: That he and Clash had sex when he was just 16, according to the celebrity-gossip Web site.

Clash, a 52-year-old dirvorced Upper West Side dad, has been on a leave of absence from “Sesame Street” since the sordid story broke last week.

Growing middle class feeds spirits business in Latin America

Diageo executive Randy Millian is proud of the fact that eight out of every 12 times someone pours a standard or premium whiskey in the Latin American and Caribbean region, they’re drinking one of his company’s brands.

That kind of dominance is why the spirits giant is bullish on its future in Latin America, which recently has been the fastest growing region for Diageo worldwide. In 2012, the Latin America and Caribbean region represented 12 percent of Diageo’s net worldwide sales and 11 percent of the company’s operating profit. Diageo hopes Brazil will become one of its top three markets by 2017, behind the U.S. and the United Kingdom.

But getting there hasn’t been easy. During periods of economic and political unrest in the region over the last decade, there were times when it would have been more profitable for Diageo to pull back, said Millian, president of Diageo Latin America and the Caribbean. Yet, the company focused on growing its scotch business across the region and it paid off. Over the last eight years, Diageo has increased sales more than two and a half times and almost tripled its operating profit.

“I believed it would get good,” said Millian, who supervises more than 3,000 employees across the region and 119 in Miami. “But I’m not sure I realized it would get this good.”

Millian has been running the region out of Diageo’s Miami office for more than a decade. But he’s also no stranger to this part of the world. He first lived in Argentina as a child and during his career has done stints in Venezuela, Brazil, Mexico and Costa Rica.

The Miami Herald sat down with Millian during a media day, which was part of a Diageo investor conference in Miami spotlighting the success in the Latin American and Caribbean region. Here is some of what Millian had to say:

Q. Has your growth over the last decade been comparable to Diageo’s growth around the world?

We would definitely be in the top positions in the league within Diageo. That’s one of the reasons they’re focusing on us. Like many corporations, the emerging markets have a huge potential for growth. I’m including Asia-Pacific, Africa and Latin America. We are seeing higher growth rates than we are seeing in the developed world, especially Europe. Although the U.S. is starting to come back, the growth rates in the emerging markets are significantly higher.

Q. What is driving the growth Diageo is experiencing in Latin America?

The improved demographics. You now have over 50 percent of the population who is middle class. You have had an increase in spending. Not only are there more people in the middle class, but you have more people in the (upper) class. We expect over the next year to have 60 million more people in the (upper) class. They’re also learning to spend money in different ways.

Q. In what countries do you see the most growth or most opportunities for future growth? Is Brazil the main focus?

There has been broad growth in Brazil, Colombia, Mexico, Chile and Peru. We have seen it all over, but those would be the ones we’re focusing on. It’s not just Brazil, it’s throughout the region.

Q. Why did you remain committed to this region over years when there was not a lot of growth and there was a lot of political and economic unrest in some countries?

Kim Kardashian and sisters to be honored by city of North Miami on Monday

The Kardashian sisters — Kim, Khloe and Kourtney — will receive keys to the city of North Miami at a special presentation on Monday led by Mayor Andre Pierre.

The sisters are living in North Miami during the filming of their new E! reality TV show Kim and Kourtney Take Miami. The move came after Miami Beach rolled-up the welcome carport to the idea of another reality show within its city limits.

The presentation to the sisters will be at 11:30 a.m. in the council chambers of North Miami City Hall, 776 NE 125 St.

Pierre will present a key to the Kardashians and give the reality stars an official welcome to North Miami.

The media has been advised the sisters will pose for photos, but will not give interviews at the event.

A lunch reception will follow the presentation.

'Twilight' finale has 8th highest-grossing debut in US with $141.3M

LOS ANGELES — The sun has set on the "Twilight" franchise with one last blockbuster opening for the supernatural romance.

"The Twilight Saga: Breaking Dawn — Part 2" sucked up $141.3 million domestically over opening weekend and $199.6 million more overseas for a worldwide debut of $340.9 million.

The finale ranks eighth on the list of all-time domestic debuts, and leaves "Twilight" with three of the top-10 openings, joining 2009's "New Moon" (No. 7 with $142.8 million) and last year's "Breaking Dawn — Part 1" (No. 9 with $138.1 million).

Last May's "The Avengers" is No. 1 with $207.4 million. "Batman" is the only other franchise with more than one top-10 opening: last July's "The Dark Knight Rises" (No. 3 with $160.9 million) and 2008's "The Dark Knight" (No. 4 with $158.4 million).

Panama Canal’s $5 billion makeover could be boon for South Florida

PANAMA CITY, Panama --
Huge yellow dump trucks resemble Tonka toys in a sand pile as they haul tons of rust-colored dirt and basalt rock from a 56-foot gash in the earth that will become a new access channel in the $5.25 billion expansion of the Panama Canal.

The trucks keep rumbling up muddy terraced slopes as a quick-moving storm blurs the horizon. The rain chases away workers pouring concrete for a mammoth set of locks that will lift super-size ships for their transit across the narrow Isthmus of Panama, but the crews are back in the pit as soon as the sun returns.

By April 2015, it will all be under water — ready for the ever-bigger vessels revolutionizing international trade. The expansion is expected to double the canal’s capacity.

The 2015 target is about six months behind schedule, but U.S. ports are still scrambling to ready their channels for so-called post-Panamax ships and some say they welcome the reprieve. At this point, Baltimore and Norfolk, Va. are the only ports along the Eastern Seaboard with channels deep enough to handle the vessels when they’re fully loaded.

Call it the race for deep water as ports up and down the East Coast, including PortMiami and Port Everglades, and along the Gulf of Mexico make plans to dredge their channels, shore up their docks or rustle up funding for renovations to receive the big ships. Many won’t be ready by the time water floods the new locks.

PortMiami in position to cash in

PortMiami is further along than most and is hoping that early advantage and its position as the first major U.S. port north of Panama will make it a preferred port of call for post-Panamax ships.

Latin American and Caribbean ports also are trying to figure out how to capitalize on the expansion.

As this new phase of canal construction nears completion with 13,000 people working around the clock, there is renewed interest in preserving the history of the old Panama Canal Zone as well as the legacy of those who worked and died building the canal.

While the 50-mile-long Panama Canal has provided a maritime shortcut between the Atlantic and Pacific for the past 98 years, it’s just about maxed out.

This year vessels from the four corners of the globe — car carriers from Japan, bulk carriers loaded with soybeans and wheat from the U.S. heartland, oil tankers, towering container ships carrying the output of Chinese factories to U.S. retailers — are expected to move a record 332 million tons of cargo through the waterway, said Jorge L. Quijano, chief executive of the Panama Canal Authority.

That’s only about 20 million tons short of the canal’s capacity, he said. The canal is also popular with cruise lines and dozens of cruise ships are being built that exceed the size limits of the current canal.

But the more immediate problem is that the huge cargo ships increasingly favored for trade with Asia are too wide, too long and too heavy for the current canal.

With a growing number of ships in the post-Panamax category — exceeding the specifications for the largest ship that can fit through the existing locks — the Panama Canal must expand or risk losing market share.

And post-Panamax vessels aren’t even the biggest on the high seas. Post-Panamax Plus ships, such as most U.S. tankers that carry liquefied natural gas bound for Asia, are five times too big for the Panama Canal.
